1. About this Privacy Policy

Thank you for visiting the Astound Commerce (“Astound Commerce” or “We”) websites (collectively the “Sites”). At Astound Commerce, we take your privacy and your trust in us very seriously. This privacy policy (“Privacy Policy”) provides you with information about how we collect, use and disclose your personal information and your rights in relation to the personal data (“Personal Data”) We hold.

“Aggregate and Anonymous Information” is any information that cannot identify or be linked to a specific individual. For example, Astound Commerce may collect anonymous group data (demographics, online browsing habits, interests and preferences, aggregate traffic data, etc.) about users of our Sites.

This Privacy Policy supersedes any previous Privacy Policy draft. The following policies are only in effect for the Sites.

We generally keep this Privacy Policy posted on our website and you should review it periodically, as it may change from time to time without notice. Any changes will be effective immediately upon the posting of the revised Privacy Policy. YOUR USE OF AND INTERACTION WITH THE SITES CONSTITUTES YOUR UNCONDITIONAL ACCEPTANCE OF THE PRACTICES DESCRIBED IN THIS PRIVACY POLICY, AS THEY MAY BE MODIFIED FROM TIME TO TIME. BY PROVIDING PERSONAL INFORMATION TO US, YOU CONSENT TO OUR COLLECTION, USE AND DISCLOSURE OF YOUR PERSONAL INFORMATION IN ACCORDANCE WITH THIS PRIVACY POLICY.

2. Information We Collect and How We Collect It

We collect information about you in two ways: directly from your input (Personal Data) and through automated technologies on our Sites (non-personally identifiable information).

2.1 Data you provide to us through optional, voluntary submissions

2.2.1. Cookies

A cookie cannot read data off your hard disk or read cookie files created by other sites. Cookies do not damage your system. We use cookies to identify which areas of Astound Commerce’s website you have visited, so the next time you visit, those pages may be readily accessible. Social media features and widgets are either hosted by a third party or hosted directly on our Sites. The information you provide is used solely by Astound Commerce and its affiliated companies. We use this information to:

In summary, Astound Commerce will only use Personal Data in ways that are compatible with the purposes for which it was collected or subsequently authorized by you. In accordance with applicable international regulations, including the EU General Data Protection Regulation (“GDPR”), You have the option to opt-out of any secondary communications such as promotional communications by clicking on „unsubscribe“ on the bottom of any Astound Commerce promotional email.

Further, consistent with international legislation, we will never knowingly request personally identifiable information from anyone under the age of 13 without requesting parental consent.

4. Sharing of Your Information

Astound Commerce uses reasonable precautions to keep the information you disclose to us secure. We do not sell, rent, share or trade your Personal Data with any third party. We only disclose Personal Data for the purposes of providing our services, and as required by law.

4.1. Performance of a contract with you:
  • Third parties whom we engage to assist in delivering the services to you;

Astound implements technical and organisational measures to seek to ensure a level of security appropriate to the risk to the personal information we process. Astound servers are protected with generally available security technologies, including firewalls and data encryption. These technologies are designed to prevent unauthorized access, but no guarantee can be made that your information and data will be secure from intrusions and unauthorized released to third parties. 7. Transfer and processing of your personal data outside the EU/Privacy Shield

Astound participates in the U.S.-EU Privacy Shield Framework and the U.S.-Swiss Safe Harbor Framework as set forth by the United States Department of Commerce regarding the collection, use, transfer, and retention of personal information from European Union member countries and Switzerland to the United States. Astound has certified that it adheres to the Privacy Shield and Safe Harbor Privacy Principles of notice, choice, onward transfer, security, data integrity, access, and enforcement with respect to all personal information within the scope of the Privacy Shield or Safe Harbor transferred from the EU or Switzerland to the U.S., respectively. The Federal Trade Commission has jurisdiction over Astound’s compliance with the Privacy Shield.

8. Modifications to the Privacy Policy

If we make any changes to our Privacy Policy, we will post those changes on this web page so that you are always aware of what information we collect, how we use it and under what circumstances we disclose it. 9. What are your Privacy Choices?

You have rights regarding the information we collect and how it’s used:

  • You have the right to object to, limit, or restrict the use of your data.

However, please note the following:

For communications, your opt-out will stop your further receipt of marketing and promotional communications from us BUT will NOT stop further communications from Astound Commerce of a transactional, administrative or relationship nature, or as required by law, such as notification of a material change in this Privacy Policy for the Sites, notification of an actual or suspected security breach that affects your Personal Data stored by or for Astound Commerce.

Astound Commerce will retain your Personally Identifiable Information for as long as is needed to provide your products or services, and as necessary to comply with our legal obligations, resolve disputes, and enforce agreements. Aggregate and Anonymous Information may be retained indefinitely.

If you choose to object to, limit, or restrict the use of your data, this decision may impair the functioning of our some of our Sites or services.

11. California Privacy Rights

Residents of the State of California, under certain provisions of the California Civil Code, have the right to request from companies conducting business in California a list of all third parties to which the company has disclosed certain personally identifiable information as defined under California law during the preceding year for third-party direct marketing purposes. You are limited to one request per calendar year. In your request, please attest to the fact that you are a California resident and provide a current California address for our response. Astound has further committed to refer unresolved Privacy Shield complaints to JAMS, an alternative dispute resolution provider located in the United States (and for European Union residents, the European Union Data Protection Authority). If you do not receive timely acknowledgment of your complaint from us, or if we have not resolved your complaint, please contact or visit JAMS (or EU DPA) for more information or to file a complaint.
